WHAT HAPPENS AFTER AN
UNSUCCESSFUL SERVICE ATTEMPT?

An unsuccessful service attempt does not necessarily mean an assignment is over. It simply means the documents were not successfully served during that particular attempt. The next step depends on what occurred at the address, the information available, the client’s instructions, the assignment deadline, and any requirements that apply to the matter.

For clients, the most important things after an unsuccessful attempt are accurate documentation, a clear status update, and enough information to decide what should happen next.

THE ATTEMPT SHOULD BE DOCUMENTED

A professional process server should create a clear record of the attempt. That record may include the date and time, the address visited, the outcome, observations relevant to the assignment, and other information that helps explain why service was not completed.

Accurate attempt records are important because they give the client a reliable picture of what occurred in the field and support any completion documentation prepared for the assignment.

THE CLIENT SHOULD RECEIVE A STATUS UPDATE

After an unsuccessful attempt, the client should know what happened rather than being left to wonder whether the assignment is still active. A useful update explains the result of the attempt and identifies any information that may help with the next step.

For example, an update may indicate that no one answered, access was restricted, the location appeared vacant, the address could not be confirmed, or information at the location suggested the subject may no longer be there.

ADDITIONAL ATTEMPTS MAY BE SCHEDULED

Many assignments involve more than one attempt. When additional attempts are appropriate under the client’s instructions and the assignment timeline, they may be scheduled at different times or under different practical circumstances in an effort to improve the opportunity for contact.

The number and timing of attempts depend on the service level, the assignment instructions, the deadline, availability, and the circumstances found at the address.

UPDATED INFORMATION CAN MAKE A DIFFERENCE

If an attempt reveals that the original information may be incomplete or outdated, the client may be able to provide additional details. Helpful information can include a corrected apartment or suite number, gate or access instructions, a better physical description, a known work location, vehicle information, or another address associated with the subject.

Providing accurate information early can reduce unnecessary delays and help the server make better-informed field attempts.

AN INCORRECT OR OUTDATED ADDRESS CHANGES THE ASSIGNMENT

If the subject appears to have moved or the address cannot be connected to the person being served, simply repeating the same attempt may not be useful. The client may need to review the information available and decide whether another address or additional location information should be provided.

DEADLINES STILL MATTER

An unsuccessful attempt can become more significant when a deadline is approaching. Clients should provide important deadlines at the beginning of the assignment and communicate any changes as soon as possible.

If time is limited, prompt communication between the client and process server helps determine whether another attempt can reasonably be scheduled within the remaining timeframe.

WHAT AN UNSUCCESSFUL ATTEMPT DOES NOT MEAN

It does not automatically mean that the subject is avoiding service, that the address is bad, or that future attempts will also be unsuccessful. People may simply be away from home, at work, traveling, behind a secured entrance, or otherwise unavailable at the time of the attempt.

Professional reporting should describe what actually occurred without making unsupported assumptions.

WHAT HAPPENS WHEN THE ASSIGNMENT CANNOT BE COMPLETED?

If the assignment reaches the end of the authorized attempts or cannot be completed within the available instructions and timeframe, the client should receive appropriate documentation showing the attempts and outcome.

What happens legally after that point depends on the case, court, jurisdiction, and applicable rules. Questions about alternative methods of service, extensions, court filings, or legal strategy should be directed to the attorney or other qualified legal professional handling the matter.
